Terms and Conditions at a glance

General scope

These terms and conditions shall be valid for the purchase and delivery of goods by Weingut Peter Schandl / www.schandlwein.com to its customers as defined in the Austrian Consumer Protection Act (KSchG). Any deviation shall be agreed upon separately in writing by us.

Our deliveries, services and offers shall only take place on the basis of these terms and conditions.

You may have a look at these terms and conditions at our website, print them out or save them locally at any time.

Conclusion of contract

The presentation of goods in our online shop shall not constitute a binding application for a conclusion of a purchase. It is rather a non-binding invitation to offer goods at our online shop.

(2) By clicking the button “finalize order with binding payment obligation”, you are giving a binding offer of purchase.

(3) Upon receipt of the purchase offer, you will get an email where we confirm having received your order.

This confirmation of receipt shall not constitute an acceptance of the purchase order and no contract shall be concluded.

(4) A purchase contract for the selected goods shall only be concluded, if we explicitly accept the purchase order and send the goods to you.

Prices

The prices mentioned on the product pages contain the Austrian statutory VAT and are given in Euro. In case of deliveries to foreign countries, deviations and price amendments may occur due to taxes, duties, fees or bank transfers. If you need further information, you may contact us at any time.

Delivery and shipment

We only accept orders where the number of bottles may be divided into 6, because the wines are shipped in boxes of 6 or 12 bottles. Our partner in shipment (dpd) calculates shipping costs per box. We will pack as few boxes as possible, of course. If you order 3 or more boxes, you will get a 50 % discount on the shipping costs.

Delivery costs

For deliveries within Austria, we calculate a flat shipping rate of 8.00 € (4.00 € for 3 or more boxes) per box (6 or 12 bottles).

For deliveries to Germany, we calculate a flat shipping rate of 12.00 € (6.00 € for 3 or more boxes) per box (6 or 12 bottles).

For deliveries to Belgium, Czech Republic, Denmark, Hungary, Luxembourg, Netherlands, Slovenia and Slovakia, we calculate a flat shipping rate of 20.00 € (10.00 € for 3 or more boxes) per box (6 or 12 bottles).

For deliveries to Sweden, Finland, France, Italy, Poland, Romania, we calculate a flat shipping rate of 25.00 € (12.50 € for 3 or more boxes) per box (6 or 12 bottles).

In case of cullet, we will replace the bottle upon confirmation by the parcel service.

Delivery

The delivery of goods takes place in special wine boxes by DPD only from Monday to Friday (for private customers in Germany also on Saturday).

By means of DPD´s tracking system, you are able to view the current state of your delivery. Email addresses and phone numbers of our customers are passed on to DPD so that the customers may be informed about the intended date of delivery.

Methods of payment

Invoice with a term of payment of 14 days from the date of the invoice (this shall not apply for launch customers, but only for registered customers). In case of exceeding the term of payment, 10% of default interest shall be charged from the first day of due date. For the second and third reminder, we additionally charge 5.00€ of reminder fees each time.

Advance payment
Autonomous bank transfer via online banking or transfer form. After we have received the money on our account, we will deliver the wine.

PayPal
You pay the amount via the online provider PayPal. You have to register there, enter with your log in details and confirm payment order (exception: guest access).

 

Right of withdrawal

You have the right to withdraw from this contact within 14 days without giving reasons. This right of withdrawal shall start at the first day the customer takes possession of the goods. In order to exercise your right of withdrawal, you need to send an explicit written statement (letter, fax, email) to Weingut Peter Schandl, where you inform them about your decision to withdraw from the contract. The timely dispatch of the withdrawal is sufficient for keeping the withdrawal period. The written withdrawal shall be sent to:

Effect of withdrawal

In the case of an effective withdrawal, the mutually received services are to be returned. Unless otherwise agreed, for repayment we shall use the same method of payment you used at the initial transaction. Paul Schandl may withhold the repayment until receipt of the goods.

You have to return the goods to us immediately and in all cases no later than 14 days after you have informed us about the withdrawal. The deadline is met if you send the goods within the period of 14 days. You shall bear the costs for returning the goods.

In case you may not return the received services in whole or in part or if you return them in a deteriorated state, you might be obliged to compensate for the value lost. Goods that are sealed for reasons of health protection or hygiene may not be returned if the sealing has been removed after delivery. The customer shall only be liable for any diminished value of the goods resulting from the handling other than what is necessary to ascertain the nature and functioning of the goods. Crystal precipitation (i.e. tartar), sediment and cork are natural and do not constitute any reason for claim.

 

Data protection

Protection of minors

Wine and spirits may only be delivered to individuals over 18.

 

Alternative dispute resolution

Alternative Dispute Resolution in accordance with Art. 14 (1) ODR-VO and § 36 VSBG:

The european commission provides a platform for online dispute resolution (OS) which is accessible at https://ec.europa.eu/consumers/odr. We are not obliged nor willing to participate in dispute settlement proceedings before a consumer arbitration board.

In the event of any conflict or inconsistency between the English and the German version of these terms and conditions, the German original shall prevail.
